After multiple appeals through the United States District Court of New Jersey and the Third Circuit Court of Appeals, the Supreme Court of the United States (SCOTUS) accepted the case in June 2017. The legal challenge against PASPA dates back to 2009 when NJ officially filed suit to overturn the act. In essence, states have broad rights to regulate their own state-run activities, such as gambling. The Tenth Amendment reserves to states all rights that are not explicitly granted to the federal government. To summarize, the Professional and Amateur Sports Protection Act of 1992 (PASPA or known as the Bradley Act) outlawed sports betting with the exemption of a few sports lotteries and licensed sports pools in four states, Oregon, Delaware, Montana, and Nevada.īasically, New Jersey argued that PASPA violated states’ rights under the US Constitution's Tenth Amendment.
